Dear Councillor Long

 

PRESERVING OUR LOCAL HISTORY

 

Since 1982 I’ve been the occupier of the above property and keen to secure a beneficial use as the incentive to restore the building in line with good conservation practices.

Unfortunately, at the start of my occupation the Council decided to prevent all stand alone uses of the building, commercial and residential, which has proved to be a catastrophe in conservation terms and leaves this building “at risk” according to English Heritage publications. According to Mr Chester Hudson, he has seen a letter dated about 1983 from a neighbour to the Council confirming the historic origins of the building. This was not reported to the Committee finally cutting off the residential use when they authorised enforcement action in 1986. It appears from the R v Canterbury City Council ex parte Springimage case of 1991, that Wealden’s decision was flawed (based on incomplete information) and therefore void. If the Council were to continue with any enforcement action with this knowledge it would be illegal (malicious), an abuse of authority and misuse of public funds, etc.

Although Cllr Jarman was my local member and apparently founder of an archaeological group, he was never keen to speak with me because of a conflict of interest, where he was Chairman of the Planning Committee in 1995 and failed to speak when his Committee was told again by the Council’s conservationist (Chezel Bird) the building held no historic interest. (Let’s not speak ill of the dead)

Councillor West was decent enough to take an interest after I explained the unfolding predicament in about 1997/8. Since that time English Heritage and East Sussex County Council have confirmed the building is one of “considerable local historic importance.” Yet the Council appear unwilling to admit they have made any error or for their Monitoring Officer to make a report as to the obvious injustice caused where their decisions have poorly founded.

Without any recourse to law via Legal Aid, I have been forced to assert my civil rights in the hope I can mount a challenge to the Council’s ongoing obstruction in defence. Please therefore find enclosed copy of correspondence challenging the Leader and the Council’s legality of operation in general.

Rather than step into the deep-end, might I suggest that at this stage you might make contact with Cllr West for an update of the current situation and perhaps after you’ve had time to reflect on the information I will supply in due course, perhaps take an active part in seeking to find a reasonable use for a unique part of Sussex history. I apologise in advance for any time this matter may absorb.
